Terms and Conditions

This website is owned and operated by CRAFT BIKES LTD. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms. Please note that they may vary from time to time without notice to you.

These terms and conditions apply to all users (including casual browsers) whether or not the registration process has been completed. Confirming that you have read and understood both these terms and conditions and our Privacy and Cookie Policy is a requirement of the contract for the provision of our services, including email marketing.

TERMS OF SERVICES 

​

By placing an order via our website (www.craftbikes.co.uk), you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. 

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays for which we will not be responsible.

In order to contract with CRAFT BIKES LTD, you must be over 18 years of age. CRAFT BIKES LTD retains the right to refuse any request made by you. If your order is accepted, we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be CRAFT BIKES LTD or may in some cases be a third party. Where a contract is made with a third-party CRAFT BIKES LTD is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card, or bank account used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of international products and services may fluctuate. All prices advertised are subject to such changes.

THE CONTRACT 

​

After you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. CRAFT BIKES LTD retains the right to accept or reject this offer before processing the order. CRAFT BIKES LTD will confirm such acceptance to you by sending you an email that confirms that the Goods have been dispatched by the delivery service provider (the "Dispatch Confirmation"). The contract between you and CRAFT BIKES LTD will only be formed when we send you the Dispatch Confirmation.

The contract will relate only to those Goods whose dispatch (by the delivery service provider) we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Goods which may have been part of your order until the dispatch of such Goods has been confirmed in a separate Dispatch Confirmation.

PRICING AND AVAILABILITY 

​

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Amount'.

The website may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfil any orders that you may place based on information on the website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

PRE-ORDERS 

​

Accepted Pre-Orders where payment has been received are binding. At CRAFT BIKES LTD, we immediately transfer said funds to our supplier to ensure and secure pre-ordered goods. In the case of the customer requesting to cancel the pre-order, a 30% cancellation fee will be held of the good’s price (Shipping costs excl.). All transaction fees that may have applied are non-refundable.

CANCELLATION BY CRAFT BIKES LTD 

​

We reserve the right to cancel the contract between us if: 

​

  • We have insufficient stock to deliver the Goods you have ordered 

  • The delivery service provider does not deliver to your area 

  • One or more of the Goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers; or 

  • We have reason to suspect that there is a risk of a fraudulent transaction 

 

If we do cancel your contract, we will notify you by email and will re-credit to your account any sum deducted by us in respect of Goods provided by us, and delivery services provided by the delivery service provider (unless amounts in respect of delivery are refunded directly by the delivery service provider), from your debit or credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

CONSUMER CONTRACTS (INFORMATION, CANCELLATION AND ADDITIONAL CHARGES) REGULATIONS 2013 

​

Under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations, you have the right to cancel your order for any item bought on this website for a full refund. This doesn't apply to: 

​

  • Items collected in store 

  • Goods made to the customer's specification or are clearly personalised 

  • Goods which are liable to deteriorate (nutrition) or expire rapidly (magazines) 

 

To cancel an order, email us contact@craftbikes.com. Please write the Order number in the subject.

​

The Consumer Contract (Information, Cancellation and Additional Charges) Regulations do not apply to Financial and Insurance Services. 

​

DELIVERY 

​

We do our best to ensure availability of all advertised products and endeavour to dispatch all parts within the quoted time. If there is a delay, we will inform you of this via email and the product will be dispatched as soon as it is available. If you have ordered multiple items they may arrive separately. 

​

CRAFT BIKES LTD has no liability to you for any delay in the delivery of products ordered. We will do our best to get all orders sent out as quickly as possible. 

​

Occasionally we find ourselves having to withdraw an item because it has become obsolete or has been discontinued. If you have placed an order for an item that has been made obsolete, we will inform you as soon as possible and offer you an alternative if one is available. 

​

RETURNS AND REFUNDS 

​

At Craft Bikes Ltd we would like to offer to our customers the best shopping experience and we are confident you will love the products that we supply to you. However, if you change your mind on your purchase, you can cancel at any time from the moment you place your order, and up to 14 days from the day you receive your goods. This is sometimes referred to as a ‘cooling-off period’.

​

You need to notify us of your wish to cancel your order within this time period by email contact@craftbikes.co.uk

 

All goods must be unused, in a saleable condition and in their original packaging with all labels still attached. Goods returned with incomplete or damaged packaging or missing or unattached tags may be refused or subject to a restocking fee.

  

Then you have another 14 days to return your goods once you have notified us. 

  

Once we receive your returned goods, one of our specialists will perform inspection to ensure they meet the criteria set out in this Returns and Refund policy. 

  

We will refund you within 5 days of receiving the goods back given they have passed this inspection. All refunds will be issued to the original payment method on the order. 

  

There are some exclusions to our returns policy, which are detailed below: 

  

  • Any special order like customised or personalised items such as wheel builds cannot be returned 

  • GPS systems such as sports watches or cycle computers can only be returned if unregistered 

  • For hygiene reasons, any intimate garments such as underwear, cycling shorts can only be returned if the items are unworn (and any protective packaging remains) 

  • Gift vouchers 

  • Products that have been opened or unsealed 

  • Products returned in an unsatisfactory condition  

  • Any service or labour we provided such as bike build service

  • Used parts, closeout items, as well as ex-display models

  • Products received over 14 days ago

  • ​Bicycles are subject to up to a 20% restocking fee

  • Please note, that we reserve the right to refuse a return if we believe the purpose was for stock trading/reselling and not personal use

These limitations do not apply to defective items or items eligible for warranty. All warranties are pursuant to the respective manufacturer’s policies. 

​

You will be liable for the return postage unless the product is faulty. Once you post it please retain your proof of postage. 

  

In the case of partial returns, Craft Bikes Ltd reserves the right to void any discounts and you will be liable to pay the full listed price advertised online.

Please note if you return items which are outside our Returns and Refund policy, we will be unable to process a full refund. We will contact you in such circumstances. 

  

If you wish to exchange an item for any reason, please place a new order for the items that you want. Please note that it is your responsibility to pay for the return postage costs if you live outside of the UK, no postage costs are refundable. We cannot assume responsibility for returned items that are lost in the post. Your statutory rights are not affected. 

 

WARRANTIES 

​

Warranties are honoured pursuant to manufacturer policies and the following conditions: 

​

  • Please email contact@craftbikes.com. Please write the Order number in the subject. 

  • You are required to provide proof of purchase and purchase date. 

  • We do not warranty items that are customer supplied. For example, if you bring us a new wheel to install, we’ll warranty the labour but not your wheel. 

  • We will objectively evaluate warranty issues and contact the manufacturer on your behalf. It is up to the manufacturer to honour their warranty based on the information we provide them. We’re on your side, within reason. 

  • Manufacturer warranties generally only apply to normal use. Any abuse or crash damage is not covered. 

  • In most cases other than bicycle framesets or bicycles we’ll replace the item on the spot if we believe the item to be defective and we’ll contact the manufacturer later so you don’t have to wait on them. This does not apply to special ordered items or items which we normally don’t stock. 

 

LIMITATION OF LIABILITY

To the extent that we are lawfully able to do so, we will not be liable for any claims, losses and/ or damages of any nature resulting from: (a) your use or inability to use the website; (b) the services we provide (except where we expressly state that we have responsibilities or liabilities in these terms and conditions or other terms and conditions that relate to our other goods and/ or services we provide); (c) unauthorised access to or alterations of your transmissions or data; (d) statements or conduct of any third parties.

You agree that in no event will our liability arising out of or in respect of these terms and conditions exceed £100 GBP and that in no event will we be liable for any loss of profits, goodwill, loss of business, loss of data or any other indirect or consequential loss or damage whatsoever. 

​

REGISTRATION 

​

Certain services are only available if you complete the registration process. By completing the registration process, you are stating that you are at least eighteen years of age or a minor with parental consent to use our website. 

Please note: All minors are recommended to discuss these terms and conditions with their parents before completing the registration process.

In return for you using our website and benefiting from our services, you agree to provide true, accurate, current and complete information about yourself where required in the registration form, and ensure that this information is kept accurate, complete and up to date. 

​

Once you have completed the registration process, you will have specified a username (email address) and a password. You must ensure that you keep your username and password in a safe and secure place and that you do not disclose them to anyone because you will be fully responsible for all activities which occur under your username and password. It is your responsibility to immediately notify us of any unauthorised use of your username and password or any other breach of security as soon as you become aware of it.

REVIEWS AND COMMENTS

We encourage you to leave reviews, comments and product questions on our website. We regularly monitor this content and we reserve the right to remove, reject or edit it at any time. When submitting information to our website as a review, product question or customer comment you understand that what you have submitted is not copyright protected and you are permitting its appearance on the CRAFT BIKES LTD website.

CODE OF CONDUCT

You are responsible for anything which you transmit or receive to, from or via or post on our website.

We do not control or screen the content of what is posted to, from or via our website by our members or third parties, and accordingly, we do not guarantee its accuracy, integrity or quality or that it will not be objectionable to you. You should not place any reliance on, nor will we be responsible or liable for anything which has been transmitted or received, or ought to have been transmitted or received but was not.

You are not permitted to use our website or any of our services for any reason or purpose which is unlawful, defamatory, harmful or objectionable and, in particular, you are not permitted to transmit anything which, in our opinion, harms our business or offends other users.

You are not permitted to transmit to, from or via or post on our website anything which you do not have a clear right to use. You must ensure that you do not transmit or post on our website any material containing software viruses or files designed to damage or disrupt the good working order of any computer or telecommunications equipment.

You are not permitted to do anything which may disrupt in any way the operation of our website and services, nor are you permitted to do anything which would disrupt the use and enjoyment of our website and our services by any other user. 

Other than as expressly permitted, by us, you are not permitted to use our website to engage in any commercial activity of any form.

We may be entitled at our discretion to refuse or remove anything which is transmitted to, from or via or posted on our website which, in our opinion, is objectionable or otherwise does not comply with these terms and conditions. We will not be liable at all for doing this.

We may record preserve and disclose anything which has been transmitted to, from or via or posted on our website and the services, where required by law or where we are acting in good faith.

TAX AND DUTY

For goods shipping to outside UK, the destination countries might charge tax and duty and you are solely responsible for paying them. CRAFT BIKES LTD will not be liable for any payment. CRAFT BIKES LTD has no liability to you for any delay or loss of goods caused by custom in the destination country.

COPYRIGHT 

​

Unless otherwise stated, all rights, including copyright, in the content of these CRAFT BIKES LTD web pages are owned and controlled for these purposes by CRAFT BIKES LTD. 

​

In accessing CRAFT BIKES LTD web pages, you agree that you may only download the content for your own individual and non-commercial use. 

​

You are not permitted to copy, broadcast, download, store, transmit, show or play in public, adapt or change in any way the content of these CRAFT BIKES LTD pages for any other purpose whatsoever, in any medium, without the prior written permission of CRAFT BIKES LTD.

FORCE MAJEURE

We shall be not liable to you or deemed to be in breach of this Contract by reason of any delay in performing, or any failure to perform, any of our obligations in relation to the Contract, if the delay or failure was due to any cause beyond our reasonable control such as (but without limitation) any strike, lock-out or other form of industrial action, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or government order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of supplier or sub-contractors or inability to obtain materials required for performance of the Contract.

GENERAL

These terms and conditions constitute the entire agreement between us in respect of the use of our services and of our website and supersede any and all prior agreements, arrangements and representations (save in respect of those made fraudulently). 

​

Data and certain other information you provide is subject to the terms of our Privacy and Cookie Policy, which can be accessed by clicking on the privacy policy link at the bottom of every page. 

​

If any of these terms and conditions are found to be invalid then that provision shall not affect the validity of the remaining provisions which shall remain fully enforceable. No waiver by us of any term shall be deemed to be continuing or shall be deemed to be a waiver of any other term.

You are not permitted to reproduce, sell or exploit for any commercial purpose any part of the website or our services. 

These terms and conditions will be interpreted and construed in accordance with the laws of England and Wales and will be subject to the non-exclusive jurisdiction of the English Courts.
